Diddy’s Lawyers Defend His Lifestyle in Pre-Trial Hearing

In a highly anticipated pre-trial hearing in New York, lawyers for rapper and music mogul Sean “Diddy” Combs offered a glimpse of his legal defense ahead of his trial for sex trafficking. The defense argued that the lifestyle Combs led was that of a “swinger,” and emphasized that his actions should not be viewed as criminal.

Legal Defense: A Lifestyle, Not a Crime

At the hearing, which took place on Friday, just over a week before the trial’s commencement, Combs’ attorneys told the court that the hip-hop mogul considered it “appropriate” to engage in sexual relationships with multiple partners, including sex workers. His legal team emphasized that this behavior is not out of the ordinary and is instead “common” in certain circles.

“There’s a lifestyle, call it swingers or whatever you will, that he thought was appropriate because it was common,” argued Marc Agnifilo, one of Combs’ lawyers. He further stressed, “Many people think it’s appropriate because it’s common.” The statement framed the defense’s central argument: Combs did not view his actions as criminal.

Plea Deal Rejected

In a twist that added complexity to the case, federal prosecutors revealed that they had offered Combs a plea deal, which he rejected. The specifics of the deal were not disclosed to the press, and the trial continues to move forward despite this offer being turned down.

The trial, which is set to begin with jury selection on May 5, involves serious charges, including racketeering conspiracy, sex trafficking, and transportation to engage in prostitution. If convicted, Combs faces the possibility of life in prison.

Courtroom Dynamics and Key Rulings

During the hearing, Combs, 55, was seen attentively listening to the proceedings, occasionally whispering and passing notes to his lawyers. A brief moment of levity came when he smiled at one of his sons, who was present in the courtroom.

Judge Arun Subramanian ruled that the defense could argue Combs’ lifestyle as part of their case, though they were not permitted to introduce examples of other notable swingers or individuals who hired sex workers. Additionally, the judge permitted prosecutors to use a video from 2016, in which Combs appears to physically assault his former partner, singer Cassie Ventura, at a hotel. Combs’ defense does not deny his involvement in the altercation but contends that the video, which was aired by CNN, is “deceptive” because it was allegedly sped up and presented out of sequence.

Video Evidence and Testimonies

Prosecutors plan to present two witnesses who will testify about the authenticity of the video footage. They also intend to introduce testimony from one alleged victim, who is expected to describe a “medical procedure” tied to the sex trafficking allegations. However, the judge has not yet ruled on whether this testimony will be allowed in court. Additional footage, which is described as “extremely sensitive,” may also be shown to the jury, though it will not be made available to the public.

The Charges Against Combs

The charges Combs faces revolve around an alleged racketeering and sex trafficking operation in which he is accused of hosting “Freak Offs” — events where his victims were allegedly coerced into sexual performances. Combs’ legal team counters that the experiences were consensual.

The trial is expected to last up to ten weeks and will take place in New York City. While it will be open to the public, the proceedings will not be livestreamed.

Opening statements for the trial are scheduled for May 12, marking a significant moment in what promises to be a high-profile case with far-reaching implications. As the trial draws near, all eyes remain on the courtroom, awaiting what will likely be one of the most significant celebrity legal battles of the year.
